This Purchase Agreement is between Sweets On A Sunday (the "Business") and all purchasers (the "Customer") effective as of 8/28/2020. By making a purchase through Sweetsonasunday.com, the Customer agrees to the following terms and conditions. This Agreement applies to all purchases, including but not limited to custom cake orders.
Agreement for Sale and Purchase
The Customer agrees to purchase the goods as described either on the website or in the custom cake contract, and Sweets On A Sunday agrees to deliver the described goods to the Customer. The Customer agrees to pay the total amount owed as indicated in their invoice.
For custom cake orders, a 50% non-refundable retainer fee is required to reserve your event date. The remaining balance must be paid by the due date stated on the invoice. Failure to do so will result in the contract being void and no refund of the retainer fee will be issued.
Delivery and Setup
2. Delivery Delays: Sweets On A Sunday will notify the Customer of any delays that
may affect the expected delivery date or time. If a pickup or delivery time needs to
be changed, both parties must agree to the new time. If the Customer is late to
the agreed-upon pickup time, a waiting fee of $15 per 15 minutes will be applied
before the cake is exchanged.
3. Customer Pickup: Upon receipt of payment, Sweets On A Sunday will make the
goods available for pickup.
The Customer assumes all liability and responsibility for the condition of the cake
or goods once it leaves our premises.
No Refunds and Refund Policy
1. The Customer will be assumed to have accepted the goods unconditionally unless
a claim of defective goods is made at the time of pickup or within 10 minutes of
delivery. No other refunds will be given beyond this point.
2. The initial retainer fee of 50% is non-refundable. Retainer fees can only be
transferred to another date upon approval from Sweets On A Sunday.
Risk of Loss
Sweets On A Sunday assumes responsibility for the goods and any risk of damage, loss, or delay until the goods are delivered. Once the goods have been delivered, or the Customer or their representative picks up the goods, the Customer assumes all responsibility for any damage or loss.
Modifications
Any changes to this Agreement, including cake designs or delivery details, must be agreed upon in writing by both the Customer and Sweets On A Sunday.
Termination
If either party terminates the agreement before product delivery, the Customer will be responsible for paying all costs incurred up to that date. The 50% non-refundable retainer will not be returned under any circumstances.
Photography
Sweets On A Sunday reserves the right to photograph any cakes or goods and use the photographs for display or promotion purposes without compensation to the Customer.
Allergy Notice
Our products may contain or come into contact with milk, wheat, eggs, nuts, soy, and other allergens. The Customer agrees to notify all guests of this risk and to hold Sweets On A Sunday harmless for any allergic reactions.
By placing an order, you acknowledge that you have read and agree to the terms of this Online Ordering and Purchasing Agreement.
